1. Statement of independence

The ARTEMIS Platform is an independent commercial product, developed and operated by CAI Technology S.R.L.. The Platform is NOT affiliated with, associated with, recognized by, certified by, validated by, accredited by, or endorsed — neither implicitly nor explicitly — by:

• the European Union or any of its institutions, agencies, or bodies (European Commission, European Parliament, Council of the European Union, EDPB, ENISA, EUIPO, AI Office, etc.);
• the Romanian State or any Romanian public authority (Government, Parliament, ANSPDCP, ANCOM, ANPC, DNSC/CERT-RO, ANAF, ASF, BNR, OSIM, MAI, ORNISS, etc.);
• standardization bodies (ISO, CEN/CENELEC, ETSI, NIST, ASRO);
• regulated professional bodies (Romanian National Union of Bar Associations, Chamber of Financial Auditors, CECCAR, Chamber of Public Notaries).

2. Nature of the information provided

The content displayed on the Platform — questionnaires, scoring scales, scores, risk levels, recommendations, guides, articles, regulatory framework descriptions, AI assistant responses, audit results, and automatically generated reports — is strictly informational and indicative. It does NOT constitute and may NOT be interpreted as:

• legal advice within the meaning of article 3 of Romanian Law no. 51/1995 on the organization and exercise of the legal profession;
• legal opinion, advice, assistance, or representation;
• tax, accounting, financial, investment, or actuarial advice;
• a compliance audit, certification, or official attestation;
• a substitute for assessment carried out by a certified professional (attorney, in-house counsel, IT auditor, IAPP-certified DPO, ISO expert);
• an official interpretation of legal acts — only the issuing authority or, where applicable, a court of law has such competence.

3. AI-generated outputs

Where the Platform uses AI systems (see AI Notice for details), the outputs (generated text, scores, classifications) are subject to inherent limitations of AI technology: hallucinations, statistical biases, dependence on training data, and difficulty with edge cases. CAI Technology S.R.L. does not warrant that AI outputs are accurate, complete, current, or appropriate for any specific purpose. The User must:

• treat AI outputs as a starting point, not as a final conclusion;
• verify factual statements against primary sources;
• consult a qualified human professional for decisions with legal, financial, or health implications.

4. No professional relationship

Use of the Platform does NOT create a professional relationship (attorney-client, auditor-client, etc.) between you and CAI Technology S.R.L.. No information you provide is covered by professional privilege, except where you explicitly contract a separate professional service under the appropriate professional and legal framework.

5. Statutory rights and exclusions

Nothing in this Disclaimer limits:

• non-waivable rights of Consumers under Government Emergency Ordinance no. 34/2014 and the Civil Code;
• CAI Technology S.R.L.'s liability for damages caused by gross negligence or fraud;
• CAI Technology S.R.L.'s liability for death or personal injury caused by negligence (where such liability cannot be excluded by law).

All other warranties — express or implied — are excluded to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Liability cap

CAI Technology S.R.L.'s aggregate liability under the Platform is capped, except where law prohibits such limitation, at the lesser of: (a) 100 EUR aggregated per year, or (b) the equivalent of 6 months of payments effectively made by the User during the 12 months preceding the event causing the damage. Consequential, indirect, lost-profit, loss-of-data, business-interruption, and reputational damages are excluded.

7. Third-party content and links

The Platform may link to or display third-party content (news articles, regulatory publications, external tools). CAI Technology S.R.L. does not endorse and is not responsible for third-party content. Use of third-party services is governed by the respective providers' terms.

8. Force majeure

CAI Technology S.R.L. is not liable for delays or non-performance caused by force-majeure events: natural disasters, war, terrorism, pandemics, governmental actions, internet/electricity outages affecting the wider region, attacks on subprocessors' infrastructure beyond CAI Technology S.R.L.'s reasonable control.

9. Intellectual property rights

The content of the Platform (text, design, code, algorithms, trademarks, logos, scoring scales, report templates) is protected by Romanian Law no. 8/1996 on copyright and related rights, and by trademark legislation (Romanian Law no. 84/1998). Any unauthorized use is prohibited. Details at Section 13 of the Terms.

10. Changes

CAI Technology S.R.L. reserves the right to amend this Disclaimer at any time. Changes are notified at least 30 days before they take effect, by e-mail and via in-Platform notification; the "Last updated" date and the version number are updated at each revision.
